Meraki Creative Works ("MCW," "we," "us," or "our") respects your privacy. This Privacy Policy explains what information we collect about you, how we use it, who we share it with, and the choices you have. It applies to your interactions with us through our website, our booking platform (Momence), our classes and studio, and our communications with you.

If you do not agree with this Privacy Policy, please do not use our services.

 

1. INFORMATION WE COLLECT

We collect information in three ways: information you give us, information we collect automatically, and information we receive from third parties.

INFORMATION YOU GIVE US directly when you register for an account, book a class or membership, sign a waiver, contact us, or otherwise interact with MCW. This may include:

  • Identity and contact information: your name, email address, phone number, mailing address, and (for minors) parent or guardian information.

  • Account credentials: usernames and passwords you create through our booking platform.

  • Payment information: credit card or other payment details. Payment information is collected and processed by our third-party payment processor (currently Momence and its underlying processors) — MCW does not store full payment card numbers.

  • Booking and participation information: classes and workshops you book or attend, products you purchase, and dates of visits.

  • Health and safety information: medical conditions, allergies, medications, pregnancy status, and emergency contact information that you provide through our Participant Waiver or to staff. We treat this information as sensitive and use it only for participant safety.

  • Information about minors: when a parent or guardian books for a child, we collect the child's name, age or date of birth, and any medical or safety information the parent provides.

  • Photos, video, and creative work: images, video, audio, and work product captured at MCW, subject to the photo and content release in the Participant Waiver.

  • Communications: messages you send us by email, through Momence, by text, or on social media; survey or feedback responses; reviews.

 

INFORMATION WE COLLECT AUTOMATICALLY when you use our website or booking platform. This may include:

  • Device and connection information: IP address, browser type, device identifiers, operating system, referring page.

  • Usage information: pages viewed, links clicked, search terms, time spent on pages, dates and times of visits.

  • Cookies and similar technologies: small files placed on your device that help our website and booking platform function and let us understand site usage. See Section 5 below.

INFORMATION FROM THIRD PARTIES, including:

  • Our booking platform (Momence), which provides us with the bookings, payments, and account activity you complete there.

  • Our payment processor, which provides us with confirmation that a payment was successful (but not your full payment card details).

  • Social media platforms, if you interact with us there — for example, if you message us through Instagram or Facebook or tag us in a post.

  • Email or marketing service providers, which may provide aggregated information about how you interact with our emails (opens, clicks, unsubscribes).

  • Anyone who refers you to us (for example, a family member who signs you up for a class).

2. HOW WE USE YOUR INFORMATION

We use the information we collect to:

  • Operate our studio and provide the services you've requested — running classes and memberships, processing bookings and payments, coordinating attendance, and maintaining safety records.

  • Communicate with you about your bookings, classes, memberships, account, and other administrative matters.

  • Keep our studio safe — for example, by maintaining medical and emergency contact information, tracking who is in the studio, and following up on incidents.

  • Comply with our legal obligations, including those of the Participant Waiver and our Membership Terms and Conditions.

  • Send you marketing communications about upcoming classes, workshops, events, and offers — only if you've opted in or where otherwise permitted by law. You can opt out at any time (see Section 8).

  • Improve our offerings — understanding what classes are popular, what's working, and what isn't.

  • Detect, prevent, and respond to fraud, security issues, and violations of our policies or the law.

  • Use photos, video, and work product as described in Section 6.

  • Other purposes you specifically consent to.

We only use sensitive information (such as medical conditions, allergies, and emergency contacts) to provide for participant safety and to respond to incidents. We do not use sensitive information for marketing.

3. HOW WE SHARE YOUR INFORMATION

We share your information only as described below. We do not sell your personal information.

WITH SERVICE PROVIDERS who help us run MCW, including:

  • Our booking and class-management platform (Momence) — to run your account, bookings, and waivers.

  • Our payment processor — to process payments.

  • Email and communication providers — to send transactional and marketing emails you've opted into.

  • Cloud storage, document signing, and similar back-office providers we use to operate the studio.

These service providers are only allowed to use your information to provide services to MCW and are required to keep your information confidential.

WITH INSTRUCTORS AND STAFF, who need access to your booking, attendance, medical safety, and emergency contact information to do their jobs.

WHEN REQUIRED BY LAW or to protect rights and safety — for example, in response to a subpoena, court order, or government request; to enforce our agreements; to investigate suspected fraud; or to protect the safety of any person.

IN CONNECTION WITH A BUSINESS TRANSFER — if MCW is involved in a merger, acquisition, financing, sale of assets, bankruptcy, or similar event, your information may be transferred to the successor entity, subject to the protections of this Privacy Policy or a successor policy.

WITH YOUR CONSENT, for any other purpose you agree to.

PUBLIC POSTS AND TAGS. If you tag, comment, or share content publicly on our social media or website, that content is public and may be re-shared by us as described in Section 6.

4. PHOTOS, VIDEO, AND CREATIVE WORK

We frequently take photographs and video at MCW for our marketing, social media, websites, and other communications. By signing our Participant Waiver, you (or, for minors, the parent or guardian) grant us permission to use these images, video, audio, and work product as described in the Waiver.

You may revoke this permission at any time by written notice to MCW (see Section 11). Revocation applies prospectively — we will stop using your image in new materials going forward, but content already published or distributed (for example, printed brochures already in circulation, or social media posts already public) may continue to exist.

If you would prefer not to be photographed at a particular session, please tell the instructor at the start of the class — we'll do our best to keep you out of frame.

 

5. COOKIES AND SIMILAR TECHNOLOGIES

Our website and booking platform use cookies and similar technologies to function, remember your preferences, analyze usage, and support marketing.

You can usually configure your browser to refuse cookies, delete cookies, or alert you when cookies are being set. If you refuse cookies, some parts of our website or booking platform may not work properly.

If we use third-party analytics (such as Google Analytics), those providers may use cookies and similar technologies to collect information about your use of our site. You can learn about Google Analytics' practices and opt out at https://tools.google.com/dlpage/gaoptout.

We honor browser-based Global Privacy Control ("GPC") signals where required.

 

6. DATA SECURITY

We use reasonable administrative, technical, and physical safeguards to protect your information against unauthorized access, disclosure, alteration, and destruction. Examples include limiting staff access on a need-to-know basis, using reputable service providers with industry-standard security, and storing paper records (if any) securely.

No method of transmission over the internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security. If we become aware of a security incident that affects your personal information, we will notify you and take other steps as required by law.

 

7. DATA RETENTION

We keep your information only as long as we need it for the purposes described in this Privacy Policy, plus any period required by law. As a general matter:

  • Account, booking, and payment records: kept for as long as your account is active and for several years after, to comply with tax, accounting, and consumer protection laws.

  • Signed waivers and consent forms: kept while the waiver is in force and for a period after to defend any potential claims, consistent with applicable statutes of limitations.

  • Medical and emergency contact information: kept as long as needed for participant safety; outdated information is replaced as you update it.

  • Marketing contacts: kept until you opt out, after which we keep only what's needed to honor your opt-out (your email address on a suppression list).

When we no longer need your information, we delete it or de-identify it.

8. YOUR CHOICES AND RIGHTS

You have several choices about your information:

MARKETING EMAILS. You can opt out of marketing emails at any time by using the "unsubscribe" link in any marketing email or by contacting us. Even if you opt out of marketing, we may still send you transactional messages — for example, booking confirmations, waiver requests, and important updates about your account.

UPDATING YOUR INFORMATION. You can update your account information at any time through the Momence platform, or by contacting us. Please keep your emergency contact, allergies, medications, and other medical safety information current.

PHOTOS AND IMAGERY. You can revoke our permission to use your image as described in Section 4.

ACCESS, DELETION, AND OTHER REQUESTS. Depending on where you live, you may have rights under applicable privacy laws — including the right to:

  • Know what personal information we have collected, used, and shared about you.

  • Receive a copy of your personal information in a portable format.

  • Correct inaccurate personal information.

  • Request deletion of your personal information, subject to legal exceptions (for example, we may need to keep waivers and tax records as described above).

  • Opt out of the sale or sharing of your personal information for cross-context behavioral advertising (we do not sell or share personal information in this way).

  • Limit the use of your sensitive personal information.

To exercise any of these rights, please contact us using the information in Section 11. We will verify your identity before responding (typically by confirming details on file). We will not discriminate against you for exercising these rights.

You may designate an authorized agent to make a request on your behalf. We will require evidence that the agent has been authorized.

 

9. CHILDREN'S PRIVACY

MCW serves children through youth classes booked by their parents or guardians. When a parent or guardian books for a minor, we collect the limited information described in Section 1 to support the child's safe participation.

Our website and booking platform are not directed to children under 13, and we do not knowingly collect personal information directly from children under 13. If a parent believes their child under 13 has provided us with personal information without parental consent, please contact us and we will delete it.

Parents and guardians of minor participants may exercise the rights in Section 8 on the minor's behalf.

 

10. CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time. When we make material changes, we will update the "Last Updated" date above and, where required by law, notify you by email or by posting a notice in the studio, on the booking platform, or on our website. Continued use of MCW after the effective date of the updated policy means you accept the changes.

We aim to respond to privacy-related requests within 45 days, as required under California law, and to other inquiries promptly.

 

12. CALIFORNIA NOTICE

This Privacy Policy is intended to comply with applicable California privacy laws, including the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), to the extent they apply to MCW. If you are a California resident, the rights described in Section 8 are available to you whether or not MCW is technically required to provide them, and we apply them as a matter of policy.

We do not sell personal information and do not share personal information for cross-context behavioral advertising as those terms are defined under California law.

NOTICE AT COLLECTION (CALIFORNIA): The categories of personal information we collect, how we use them, and how long we retain them are described in Sections 1, 2, and 7 above. We do not use or disclose sensitive personal information beyond the purposes described in this Privacy Policy.
